Welcome to Sugarfree Studio! We’re thrilled to be part of your special moments. To ensure a smooth, transparent, and professional experience for all our clients, we’ve outlined our Terms and Conditions below. By booking our services, you agree to these terms, so please read them carefully.

1. Booking & Contracts

1.1. Booking Process

  • All photography and videography services must be reserved with a signed contract and a non-refundable deposit.
  • Deposits are typically 50% of the total package price and are required to secure your date.
  • Full payment is due 30 days prior to your event or session, unless otherwise agreed upon in your contract.

1.2. Contracts

  • A signed contract is required to confirm your booking.
  • Contracts outline services, deliverables, timelines, and payment terms.
  • Verbal agreements are not considered binding. All terms must be documented in writing.

2. Payments & Fees

2.1. Payment Methods

We accept credit/debit cards, bank transfers, and checks. Payment details will be provided in your contract and invoice.

2.2. Late Payments

  • Payments received after the due date may incur a late fee of 5%.
  • Failure to pay in full by the due date may result in cancellation of services.

2.3. Additional Fees

  • Travel fees may apply for destinations outside our local service areas (e.g., flights, accommodations, or transportation).
  • Overtime fees may apply if your event or session exceeds the agreed-upon time.
  • Permit or venue fees (if required for your location) are the client’s responsibility.

3. Cancellation & Rescheduling Policy

3.1. Cancellations by the Client

  • Deposits are non-refundable in the event of a cancellation.
  • If you cancel 6 months or more before your event/session, you may apply your deposit to a future booking (subject to availability).
  • If you cancel less than 6 months before your event/session, your deposit will be forfeited, and any additional payments made will be non-refundable.

3.2. Rescheduling by the Client

  • Rescheduling requests must be made at least 30 days in advance of your event/session.
  • Rescheduling is subject to availability and may incur a fee of up to 25% of the package price if the new date requires additional travel or resources.
  • Rescheduling within 30 days of your event/session may be treated as a cancellation, and your deposit may be forfeited.

3.3. Cancellations by Sugarfree Studio

  • In the unlikely event that we must cancel your booking due to unforeseen circumstances (e.g., illness, emergency, or extreme weather), we will:
    • Refund your deposit and any payments made in full.
    • Make every effort to find a replacement photographer of equal or greater experience.
  • Sugarfree Studio is not responsible for any additional costs incurred by the client due to cancellation (e.g., venue fees, travel expenses).

4. Service Delivery

4.1. Timelines

  • Edited images will be delivered within 4-8 weeks of your event or session, unless otherwise specified in your contract.
  • Rush delivery may be available for an additional fee.
  • Same-day edits or previews may be provided for an additional fee, depending on availability.

4.2. Deliverables

  • All deliverables (e.g., digital files, albums, prints) will be specified in your contract.
  • Digital files are delivered via a private online gallery with high-resolution images for personal use.
  • Prints and albums are shipped to your specified address within the agreed timeline.

4.3. Revisions & Retouching

  • Basic editing (e.g., color correction, exposure adjustments) is included in all packages.
  • Advanced retouching (e.g., blemish removal, body adjustments) may incur an additional fee.
  • Revisions to your final gallery are limited to 3 rounds of minor adjustments. Additional revisions may incur a fee.

5. Usage Rights & Licensing

5.1. Personal Use

  • You are granted a personal, non-exclusive license to use, print, and share your images for personal, non-commercial purposes (e.g., social media, family albums, or home decor).
  • You may not sell, alter, or use the images for commercial purposes without prior written consent from Sugarfree Studio.

5.2. Commercial Use

  • Commercial use of images (e.g., advertising, marketing, or publication) requires additional licensing and fees.
  • Sugarfree Studio retains the copyright to all images and reserves the right to use them for portfolio, marketing, and promotional purposes, unless otherwise agreed upon in writing.

5.3. Social Media & Publication

  • We love sharing the love! Sugarfree Studio may feature your images on our website, social media, or marketing materials.
  • If you prefer not to have your images shared, please notify us in writing prior to your event or session.

6. Liability & Limitations

6.1. Limitations of Liability

  • Sugarfree Studio is not responsible for any loss, damage, or theft of personal property (e.g., attire, accessories, or decorations) during your event or session.
  • We are not responsible for any injuries, accidents, or damages that occur during your event or session, unless caused by our negligence or willful misconduct.

6.2. Force Majeure

  • Sugarfree Studio is not liable for failure to perform services due to unforeseen circumstances beyond our control, such as:
    • Natural disasters (e.g., hurricanes, earthquakes).
    • Government restrictions (e.g., travel bans, venue closures).
    • Equipment failure (unless due to our negligence).

6.3. Equipment & Data Loss

  • While we take every precaution to protect your images, Sugarfree Studio is not liable for data loss, corruption, or damage due to technical failures, accidents, or other unforeseen events.
  • We strongly recommend that you back up your images once delivered.

7. Privacy Policy

7.1. Data Collection

  • We collect personal information (e.g., name, email, phone number) only for the purpose of providing our services and communicating with you.
  • We do not sell or share your personal information with third parties, except as required by law.

7.2. Data Storage

  • Your images and personal information are stored securely and confidentially.
  • Digital galleries are password-protected and accessible only to you and those you share them with.

7.3. Cookies & Tracking

  • Our website may use cookies and tracking technologies to enhance your experience and analyze site traffic.
  • You can opt out of cookies through your browser settings, but this may affect your experience on our site.

8. Travel & Additional Services

8.1. Travel Fees

  • Travel fees may apply for destinations outside our local service areas (Miami, FL).
  • Travel fees typically cover flights, accommodations, transportation, and per diems for our team.
  • Exact travel fees will be outlined in your contract.

8.2. Additional Services

  • Add-ons (e.g., videography, photo booths, albums) may incur additional fees.
  • Custom requests (e.g., extended coverage, rush delivery) will be quoted separately.

9. Client Responsibilities

9.1. Venue & Permits

  • You are responsible for securing any necessary permits for your event or session location (e.g., park permits, venue restrictions).
  • You must inform us of any venue rules (e.g., no flash photography, restricted areas) that may affect our services.

9.2. Timeline & Coordination

  • You are responsible for providing a detailed timeline for your event or session.
  • Delays or changes to the timeline may affect the coverage we can provide.

9.3. Guest & Vendor Coordination

  • You are responsible for coordinating with guests and vendors (e.g., family for portraits, planners for logistics).
  • We are not responsible for managing or directing your guests or vendors.

10. Intellectual Property

10.1. Ownership

  • Sugarfree Studio retains full copyright to all images and videos created during your event or session.
  • You are granted a personal, non-exclusive license to use the images for personal purposes, as outlined in Section 5 (Usage Rights & Licensing).

10.2. Commercial Use

  • Commercial use of images (e.g., advertising, marketing, or publication) requires additional licensing and fees.
  • Unauthorized commercial use may result in legal action.

11. Changes to Terms

  • Sugarfree Studio reserves the right to update or modify these Terms and Conditions at any time.
  • Continued use of our services after changes are posted constitutes acceptance of the new terms.
  • We will notify you of any significant changes via email or our website.

12. Governing Law

  • These Terms and Conditions are governed by the laws of the State of Florida.
  • Any disputes will be resolved in the courts of Miami-Dade County, Florida.
